Welcome to Defog. These Terms of Service ("Terms") govern your use of the Defog mobile application and related services (collectively, the "Service") operated by Defog ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Description of Service

Defog is a mobile application designed to support individuals in reducing or stopping their cannabis use. The Service includes:

• Progress tracking and milestone celebrations
• An AI-powered coach for personalized support
• Journaling features to track thoughts and triggers
• Educational content about cannabis cessation
• Community features (if applicable)

2. Important Disclaimer

DEFOG IS NOT A MEDICAL SERVICE. The information and support provided through the Service is for general informational purposes only and should not be considered medical advice, diagnosis, or treatment.

The AI coach and other features are tools to support your personal journey, but they are not substitutes for professional medical care. If you experience severe withdrawal symptoms, mental health concerns, or other health issues, please seek help from qualified healthcare professionals.

In case of emergency, call emergency services (911 in the US) or go to your nearest emergency room.

3. Eligibility

To use the Service, you must:

• Be at least 13 years old
• If between 13 and 18, have permission from a parent or guardian
• Have the legal capacity to enter into these Terms
• Not be barred from using the Service under applicable law

4. Account Registration

To access certain features, you may need to create an account. When you create an account, you agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

Subscription Required

A Defog Pro subscription is required to access the app's features and content. Defog Pro is available as a weekly, monthly, or yearly subscription.

Payment Terms

Subscriptions are billed through the Apple App Store. By subscribing, you agree to:

• Apple's terms and conditions for in-app purchases
• Payment being charged to your Apple ID account at confirmation of purchase
• Automatic renewal unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account being charged for renewal within 24 hours prior to the end of the current period

Managing Your Subscription

You can manage and cancel your subscription at any time by going to your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Refunds

Refund requests are handled by Apple according to their refund policy. To request a refund, contact Apple Support or use the "Report a Problem" feature in your purchase history.

6. User Conduct

When using the Service, you agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Upload malicious code or interfere with the Service
• Attempt to gain unauthorized access to the Service
• Use the Service to collect user information without consent
• Sell, resell, or exploit the Service commercially
• Use automated systems to access the Service

7. User Content

You retain ownership of content you create in the Service (such as journal entries). By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Use anonymized, aggregated data to improve the Service

We will never share your personal journal entries with third parties or use them for advertising purposes.

8. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Defog and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

9. Third-Party Services

The Service may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEFOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages resulting from your use of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of information

12. Indemnification

You agree to indemnify and hold harmless Defog and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and data (subject to our data retention policy)
• Provisions that should survive termination will remain in effect

You may terminate your account at any time by deleting it through the app settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. For significant changes, we will also notify you through the app or via email.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Defog regarding the Service.
